What is Subletting or Subleasing?

If you cannot carry out the terms of your lease through the end of your leasing term, you may consider subletting your property. This means you will lease to another individual who will carry out the terms of your lease. However, not all properties allow this. Be sure to check your lease agreement to see if it is an option for you.

What to Do if You Want to Sublease

First and foremost, always check your lease and contact your landlord to see if it is allowed. Some rental properties do not allow for tenants to sublet their spaces. If your property does allow subleasing, they may have certain guidelines or protocols for you to follow. If you sublet without letting your landlord know, that may be considered a direct violation of the leasing agreement and can make you subject to eviction.

Always be considerate of your roommates. Whoever you choose to sublease to will become their new roommate, so be sure they are okay with your decision before you go any further.

Be aware that if you do sublease, you are still the primary lease holder. This means if for any reason who you sublet to cannot pay rent, you are responsible. If you ask your sub-tenant for a security deposit, it cannot exceed more than the cost of 1 months rent.
